1. General provisions

1.1. This document ("Terms and Conditions" or "T&C") governs the relationship between -, headquartered at -, registered at the Trade Registry under no. -, Tax ID -, email: -, phone: - ("the Company", "We" or "the Operator") and persons who use the JoburiOnline.ro platform and its associated services ("the User" or "You").

1.2. The purpose of this document is to establish the rights and obligations of the parties regarding access to and use of the JoburiOnline.ro platform, including all features, content and services available through it.

1.3. By creating an account on the platform and checking the box "I have read and accept the Terms and Conditions", you express your explicit and unequivocal agreement to this document in its entirety. If you do not agree with any of the provisions below, please do not use the platform.

1.4. We recommend checking this page periodically for any updates to the Terms and Conditions. Continued use of the platform after publication of changes constitutes tacit acceptance of the new provisions.

2. Definitions

2.1. For the purposes of this document, the following terms have the meanings below:

  • Platform — the JoburiOnline.ro website, including mobile versions, associated applications and all features made available by the Company.
  • User — any natural or legal person who accesses and/or uses the platform, regardless of whether they hold a registered account.
  • Candidate — a registered natural person user who is seeking employment and uses candidate services (profile creation, CV upload, job applications).
  • Company / Employer — a registered legal person or authorized individual user who publishes job postings and accesses the CV database.
  • Account — the set of data (email address, password, profile information) that enables identification and authentication of a user on the platform.
  • Services — all features offered through the platform, both free and paid.
  • User-Published Content — any information, text, image, document or material uploaded, published or transmitted by a user through the platform (CVs, job postings, messages, reviews, etc.).
  • Job posting — a job offer published by a Company on the platform, describing an available position, requirements, benefits and, mandatorily, the salary range offered.

3. Description of services

3.1. Services for candidates:

  • Creating and managing a professional profile and online CV;
  • Searching and filtering job postings, including by salary criteria;
  • Applying to job postings published on the platform;
  • Receiving personalized job alerts and recommendations through AI algorithms;
  • Tracking application status in real time;
  • Setting profile and CV visibility options.

3.2. Services for companies:

  • Creating and managing a company profile;
  • Publishing job postings with transparent salary;
  • Accessing the candidate CV database (according to purchased package);
  • Receiving and managing candidate applications;
  • Access to selection and candidate communication tools.

3.3. The platform offers both free and paid services. Free services are available within reasonable usage limits. The Company reserves the right to limit, modify or suspend access to free services if it determines abusive, excessive or improper use inconsistent with the platform's purpose.

3.4. Details regarding paid services, available packages and pricing are presented on the dedicated page on the platform and in section 12 of this document.

4. Account registration

4.1. To use the platform's full features, you must create an account. Upon registration, you are required to provide accurate, complete and current information. Providing false or misleading information constitutes a violation of these Terms and Conditions.

4.2. The minimum age for creating an account on the platform is 16 years. By creating an account, you declare that you have reached this age.

4.3. You are responsible for maintaining the confidentiality of your authentication credentials (email and password) and for all activities conducted through your account. You agree to notify us immediately of any unauthorized use of your account.

4.4. Company verification: The Company reserves the right to verify the authenticity of registered companies, including by checking the Tax ID with the Trade Registry and tax status on the ANAF portal. Companies that cannot be verified or that provide inaccurate data may be suspended or blocked.

4.5. Companies publishing postings for positions outside Romania are required to present, upon platform request, valid documents issued by the Territorial Labour Inspectorate (ITM) or competent authorities of the target country, certifying the legality of international recruitment.

4.6. The Company reserves the right to suspend or delete, without prior notice, accounts containing false or incomplete data or that violate these T&C.

5. Company obligations (Employer Users)

5.1. Salary disclosure is mandatory. Every job posting published on the platform must include the salary range offered for the position (minimum and maximum salary, gross or net, with clear specification of the type). Postings without salary information will not be published on the platform.

5.2. Obligation to respond to applications within 7 days. Companies undertake to provide a response to each candidate who applies to a posting, within a maximum of 7 (seven) calendar days from the date of receiving the application. The response may be an interview invitation, a request for additional information or a reasoned rejection notification. The company's response rate is publicly visible on its profile.

5.3. Information published in job postings and on the company profile must be real, complete, current and must not mislead candidates.

5.4. A job posting must correspond to a single distinct position, even if it targets multiple identical roles within the same position.

5.5. Publishing discriminatory postings is strictly prohibited, on grounds of race, nationality, ethnicity, language, religion, sex, sexual orientation, political opinion, trade union membership, disability, age or any other criterion protected by applicable legislation.

5.6. Publishing contact details (phone, email, website, social media links) in the body of the job posting, its title or in fields intended for position description is prohibited. Contact details are displayed exclusively through the company's verified profile.

5.7. Companies undertake not to use candidate data obtained through the platform for purposes other than the recruitment process for which it was provided, and under no circumstances for competitive purposes, unsolicited direct marketing or resale to third parties.

6. Candidate obligations

6.1. Candidates undertake to provide real, accurate and current information in their personal profile, uploaded CV and any communication through the platform.

6.2. Creating multiple accounts by the same person is prohibited. Each candidate may hold only one active account on the platform.

6.3. Using the platform for fraudulent purposes is prohibited, including but not limited to: impersonating another person, applying to postings to collect company information, or using the platform for spam activities.

6.4. Candidates may choose their CV and profile visibility level:

  • Public — CV and profile are visible to companies that have purchased CV database access;
  • Confidential — CV and profile are visible only to companies to which the candidate has directly applied.

7. Prohibited content

7.1. The following types of content are strictly prohibited on the platform. Publishing, uploading, transmitting or distributing such materials will result in the sanctions provided in section 14:

  • a) Pornographic, erotic or sexually explicit content, including images, text or links to such materials;
  • b) Obscene, vulgar, defamatory, slanderous, threatening or discriminatory materials;
  • c) Computer viruses, malware, spyware, trojans, destructive code or any other software designed to interfere with the operation of the platform or users' devices;
  • d) Unsolicited messages (spam), junk mail, pyramid schemes, "get rich quick" schemes or any form of unauthorized commercial communication;
  • e) Materials protected by copyright, registered trademarks or other intellectual property rights, without express authorization from the rights holder;
  • f) Confidential information, trade secrets or data protected by confidentiality agreements belonging to third parties;
  • g) Content promoting violence, illegal activities, terrorism or animal cruelty;
  • h) Publishing personal data (national ID number, ID card details, home address, bank account numbers) in public fields of the platform;
  • i) Postings for videochat, escort, erotic massage or any other form of sexual exploitation;
  • j) Incomplete, misleading, exaggerated or aggressive postings intended to deceive candidates about the nature or actual conditions of the position offered;
  • k) Content contrary to good morals or using licentious, offensive language or content that undermines personal dignity;
  • l) Use of bots, crawlers, spiders, automated scripts or any other software tools for accessing, extracting or manipulating data from the platform;
  • m) Direct or indirect advertising of competing platforms within postings or profiles;
  • n) Content that violates applicable legislation in Romania or the European Union;
  • o) Audio or video recordings made without the consent of the persons involved;
  • p) Any other material or behavior that, by its nature, is likely to affect the proper functioning of the platform, the Company's reputation or the rights of other users.

8. Content moderation and reporting

8.1. The platform has no general obligation to monitor user-published content, in accordance with Art. 8 of Regulation (EU) 2022/2065 on Digital Services (DSA).

8.2. However, the Company reserves the right to voluntarily investigate content published on the platform and to remove or restrict access to any content that violates these T&C or applicable legislation, without being obligated to notify the user in advance.

8.3. Reporting mechanism: Any user may report content they consider illegal or contrary to the T&C via the report button available on each posting and profile, or by sending an email to -. The report must contain a clear description of the targeted content and the reason for reporting.

8.4. The Company will review each report within a reasonable timeframe, generally within a maximum of 15 business days from receipt, and will communicate the decision to the reporter.

8.5. In accordance with Regulation (EU) 2022/2065 (DSA), to the extent the platform reaches applicable thresholds, the Company will comply with the transparency, reporting and cooperation obligations with authorities provided by this regulation.

9. Intellectual property

9.1. All content on the JoburiOnline.ro platform — including but not limited to: design, structure, texts, graphics, logos, icons, images, audio and video files, software and source code — is the exclusive property of Clever Applications SRL or its licensors and is protected by Romanian and international copyright and intellectual property legislation.

9.2. Users may access and use the platform's content exclusively for personal, non-commercial purposes. Reproducing, modifying, distributing, republishing, transmitting or commercially exploiting any element of the platform without the Company's prior written consent is prohibited.

9.3. License granted by users: By publishing content on the platform (CVs, job postings, profile descriptions, images, etc.), you grant the Company a non-exclusive, transferable, sublicensable, royalty-free license, valid for the duration of the account's existence, to use, reproduce, adapt, translate, distribute and publicly display such content for the purpose of providing and promoting the platform's services.

9.4. Automated access to the platform through bots, crawlers, spiders, scraping tools or any other software tools without the Company's prior written consent is strictly prohibited. Systematic extraction of data from the platform constitutes a violation of intellectual property rights and may result in civil and criminal liability.

9.5. Unauthorized access to the platform's servers, databases or technical infrastructure constitutes a criminal offence under Art. 360-365 of the Romanian Criminal Code and will be reported to criminal investigation authorities.

10. Personal data protection (GDPR)

10.3. Categories of data collected:

  • Identification and contact data: name, surname, email address, phone number;
  • Professional data: work experience, education, skills, certifications, uploaded CVs;
  • Company data: name, Tax ID, registered office address, contact details, contact persons;
  • Browsing and technical data: IP address, browser type and version, operating system, pages visited, session duration;
  • Data collected through cookies and similar technologies (see section 11).

10.4. Purposes of processing:

  • Providing platform services (account creation, posting publication, application, candidate-employer matching);
  • Improving services through personalized AI-based recommendations;
  • Administrative and service communications (notifications, alerts, confirmations);
  • Marketing communications (newsletter, special offers) — only with your consent;
  • Aggregate statistics and analyses on platform usage;
  • Fraud prevention and platform security;
  • Compliance with the Company's legal obligations.

10.5. Legal bases for processing:

  • Art. 6(1)(b) GDPR — performance of the contract (these T&C) and provision of requested services;
  • Art. 6(1)(a) GDPR — your consent, for marketing communications and non-essential cookies;
  • Art. 6(1)(f) GDPR — our legitimate interest, for service improvement, fraud prevention and platform security;
  • Art. 6(1)(c) GDPR — legal obligation, for compliance with tax, accounting and reporting requirements.

10.6. Data recipients:

  • Employer companies — within the scope of the recruitment process and according to the visibility settings chosen by the candidate;
  • Technical service providers (hosting, email, analytics, payment processing) — based on processing agreements pursuant to Art. 28 GDPR;
  • Public authorities — when required by law.

10.7. International data transfers: Your data is stored on servers located in the European Union. Where certain service providers (e.g., analytics or communication services) process data outside the EU/EEA, the Company ensures that adequate safeguards are implemented in accordance with Art. 46 GDPR (Standard Contractual Clauses or adequacy decisions).

10.8. Data retention period:

  • Account data: for the entire duration of the active account;
  • After account deletion: data is anonymized or deleted within 30 days, except for data we are legally required to retain (tax data — 10 years);
  • Inactive accounts: data is retained for a maximum of 5 years from the last login, after which it is automatically deleted;
  • CVs in employer accounts: automatically deleted 12 months after download/save.

10.9. Your rights under GDPR:

  • Right of access (Art. 15) — you may request confirmation of processing and a copy of your data;
  • Right to rectification (Art. 16) — you may request correction of inaccurate data;
  • Right to erasure (Art. 17) — you may request deletion of data, subject to legal retention obligations;
  • Right to restriction of processing (Art. 18) — you may request limitation of processing in certain situations;
  • Right to data portability (Art. 20) — you may request to receive data in a structured, commonly used format;
  • Right to object (Art. 21) — you may object to processing based on legitimate interest;
  • Right to withdraw consent — at any time, without affecting the lawfulness of prior processing;

11. Cookie policy

11.1. Cookies are small text files placed on your device by our platform, used to ensure proper functioning, personalize your experience and analyze traffic.

11.2. Categories of cookies used:

  • Strictly necessary cookies — essential for platform operation (authentication, session, security). Cannot be disabled.
  • Functional cookies — remember your preferences (language, display settings) for an enhanced experience.
  • Analytics cookies — collect aggregate information about how you use the platform, enabling us to improve our services (e.g., Google Analytics).
  • Advertising cookies — used to display relevant advertisements and measure the effectiveness of advertising campaigns.

11.3. On your first visit to the platform, you will be informed through a banner about the use of cookies and will be able to choose which cookie categories you accept. You may change your preferences at any time from the platform settings.

11.4. You may also configure your browser to block or delete cookies. Consult your browser's help section:

  • Mozilla Firefox: Options > Privacy > Cookies
  • Safari: Preferences > Privacy
  • Microsoft Edge: Settings > Cookies and site permissions

11.5. Disabling non-essential cookies does not affect the platform's basic functionality, but may limit certain personalized features.

12. Paid services and payment terms

12.1. The platform offers the following categories of paid services (detailed list and updated prices are available on the dedicated page):

  • Job posting publication packages (various visibility and promotion levels);
  • Access to the candidate CV database;
  • Company profile promotion services;
  • Candidate service packages (CV promotion, profile analysis).

12.2. All prices are expressed in RON (Romanian lei) and include VAT, unless otherwise specified. For prices expressed in EUR, conversion is made at the BNR exchange rate on the date of invoice issuance.

12.3. Payment may be made by:

  • Bank transfer based on the proforma invoice issued by the Company;
  • Online card payment (through a secure payment processor);
  • Any other payment method indicated on the platform.

12.4. The tax invoice will be issued and transmitted electronically in PDF format to the email address associated with the account, in accordance with applicable tax legislation.

12.5. Purchased services are valid for the period indicated at the time of purchase (generally 12 or 24 months, depending on the package). After the validity period expires, unused services cannot be recovered or refunded.

12.6. Amounts paid for already activated services are non-refundable in the event of discontinuation of platform use at the user's initiative or as a result of account suspension/blocking for T&C violations.

12.7. Candidate CVs saved in employer accounts are automatically deleted 12 months after the save date, in accordance with the data protection policy.

13. Right of withdrawal for consumers

13.1. Pursuant to Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, you have a right of withdrawal within 14 calendar days from the date of purchasing a paid service, without having to state a reason.

13.2. To exercise the right of withdrawal, send an unequivocal statement (e.g., a letter sent by post or an email) to: -. We recommend using the withdrawal form available on the platform, but this is not mandatory.

13.3. Exceptions to the right of withdrawal (pursuant to Art. 16 of GEO 34/2014): The right of withdrawal does not apply to services that have been fully performed before the expiry of the withdrawal period, provided that performance began with your prior explicit consent and acknowledgment that you will lose the right of withdrawal upon full performance of the service.

13.4. In the event of valid exercise of the right of withdrawal, the Company will refund the amounts paid within a maximum of 14 days from the date it was informed of the withdrawal decision, using the same payment method you used for the purchase.

14. Sanctions and access restrictions

14.1. The Company may apply the following measures in case of violation of these T&C, proportional to the severity and frequency of violations:

  • Warning — for minor violations, at first offence (e.g., incomplete information, non-compliance with posting format);
  • Temporary suspension — for moderate violations or repeated offences:
    • 7 days — for a second minor violation or first moderate violation;
    • 15 days — for a third violation or second moderate violation;
    • 30 days — for serious violations that do not warrant permanent blocking;
  • Permanent blocking — for serious or repeated violations, including but not limited to: publishing pornographic content, creating fake profiles, repeated spam, publishing illegal content, attempting unauthorized access to platform systems.

14.2. If a user has benefited from free services by defrauding platform mechanisms (multiple accounts, false data, etc.), the Company has the right to retroactively revoke those benefits.

14.3. Right to contest: The user affected by a restriction decision has the right to contest that decision according to the procedure provided in section 15.

15. Internal complaint resolution system

15.1. Users affected by a restriction decision (warning, suspension or blocking) have the right to file a complaint within 6 months of the decision being communicated.

15.2. Complaints should be sent to the email address: -, with the subject "Decision contest — [account name]". The complaint must contain the reasons why you consider the decision unjustified, as well as any relevant evidence.

15.3. The Company will review the complaint and communicate a reasoned response within a maximum of 30 calendar days from receipt.

15.4. If you are not satisfied with the response received, you have the right to appeal to:

  • A certified out-of-court dispute resolution body in accordance with Regulation (EU) 2022/2065 (DSA), if applicable;
  • The competent courts in Romania.

16. Limitation of liability

16.1. The JoburiOnline.ro platform acts exclusively as a digital intermediary between candidates and employer companies. The Company is not a party to the legal relationships between them and assumes no responsibility regarding hiring decisions, working conditions or the outcome of recruitment processes.

16.2. The platform's services are provided "as is" and "as available". The Company does not guarantee:

  • The accuracy, completeness or currentness of information published by users;
  • Uninterrupted, error-free or vulnerability-free operation of the platform;
  • Achievement of any particular result (employment, finding the right candidate) through use of the services;
  • Compatibility of the platform with all devices and software configurations.

16.3. The Company is not liable for direct, indirect, incidental, special or punitive damages, loss of profit, loss of data or any other damages resulting from the use or inability to use the platform.

16.4. Each user is solely responsible for the content they publish on the platform and for the consequences of such publication.

16.5. The user undertakes to fully indemnify the Company for any damages, court costs, attorney fees or other costs incurred as a result of the user's violation of these T&C or applicable legislation.

17. Force majeure

17.1. The Company is exempt from any liability for non-performance, delayed performance or improper performance of its obligations when caused by force majeure or fortuitous events, including but not limited to: natural disasters, fires, floods, pandemics, wars, embargoes, major technical failures of internet infrastructure, cyberattacks, computer viruses, unauthorized access to servers from external causes, strikes, acts or regulations of public authorities, or any other causes beyond the Company's control.

17.2. The occurrence of force majeure will be notified to users through the platform or by email, as soon as possible.

18. Third-party links

18.1. The platform may contain links or references to websites, services or resources operated by third parties. These links are provided for informational purposes only.

18.2. The Company does not control, endorse or bear responsibility for the content, availability, privacy policies or practices of third-party sites. Access to them is at your own risk.

18.3. Inclusion of a link on the platform does not constitute or imply approval, affiliation or recommendation by the Company.

19. Advertising

19.1. The platform may display advertisements and promotional materials from third parties. Advertising revenue contributes to the financial sustainability of free services offered to users.

19.2. The Company is not responsible for the quality, accuracy or legality of products, services or offers promoted by third parties through advertisements displayed on the platform.

19.3. Your interaction with advertisers takes place exclusively between you and the respective third parties, with the Company not being a party to these relationships.

20. Communications and newsletter

20.1. By creating an account, you agree to receive administrative communications related to the operation of your account and platform services (confirmations, security notifications, T&C updates, technical information). These messages are an integral part of the service and cannot be individually disabled.

20.2. Commercial communications (newsletter, special offers, promotions, job/candidate recommendations) will only be sent with your prior consent.

20.3. You may opt out of commercial communications at any time through the unsubscribe link present in each email or from your account settings on the platform.

21. Amendment of terms

21.1. The Company reserves the right to update or modify these Terms and Conditions at any time, to reflect changes to services, legislation or business practices.

21.2. In the event of substantial modifications, users will be notified through:

  • Email sent to the address associated with the account; and/or
  • Visible notification on the platform (banner or in-account message).

21.3. Professional users (companies): in accordance with Regulation (EU) 2022/2065 (DSA), substantial T&C modifications will be communicated with a minimum notice of 15 days before taking effect.

21.4. Continued use of the platform after the new Terms and Conditions take effect constitutes tacit acceptance thereof. If you do not agree with the changes, you have the right to delete your account before they take effect.

22. Applicable law and jurisdiction

22.1. These Terms and Conditions are governed by and interpreted in accordance with the laws of Romania.

22.2. Any dispute arising from or in connection with the use of the platform and these T&C will be resolved by the competent courts in Romania.

22.3. Before filing a court claim, the parties will make reasonable efforts to resolve the dispute amicably.

22.4. Online Dispute Resolution (ODR) platform: Consumers in the European Union may access the European online dispute resolution platform at: https://ec.europa.eu/consumers/odr.

23. Final provisions

23.1. Severability clause: If any provision of this document is declared null, voidable or unenforceable by a competent court, the remaining provisions shall remain valid and produce their effects in full.

23.2. This document constitutes the entire agreement between the Company and the User regarding the use of the JoburiOnline.ro platform and supersedes any prior agreement, understanding or arrangement, whether written or oral, regarding the same subject matter.

23.3. The fact that the Company does not exercise or exercises with delay any of the rights provided in these T&C does not constitute a waiver of that right.

23.4. Official communications between the parties are made through the email addresses associated with the account (for the user) and at - (for the Company).
